By accessing or using the PLAN-D Poker ("the Site") to participate in poker tournaments, you ("the User") agree to abide by these Terms & Conditions. If you do not agree with any provision, you must refrain from using the Site.

2. No Rake, No Gambling Services

No Rake: PLAN-D Poker does not charge any rake or commission on any tournament. Any fees collected (if applicable) cover administrative or hosting costs only and are not related to gambling or wagering.

Not a Gambling Site: PLAN-D Poker merely provides a platform for recreational or friendly poker tournaments. We do not facilitate or promote any form of real-money gambling where the house or operator takes a profit share.

3. Eligibility

Legal Age: You must be at least 18 years old—or the age of majority in your jurisdiction—to use the Site. By using the Site, you represent and warrant that you meet this requirement.

4. Tournament Rules & Conduct

Friendly Environment: The Site is designed to foster a fun, fair, and respectful community. Unsportsmanlike conduct, harassment, or cheating is strictly prohibited.

Fair Play: Users must comply with the poker tournament rules posted on the Site. Any attempt to manipulate game outcomes or engage in collusion is grounds for immediate suspension and a forfeiture of your funds.

No Warranties on Outcome: PLAN-D Poker does not guarantee any level of success or winnings for participants. All participants enter tournaments at their own risk.

5. Payments & Fees

Fees: If any entry fees or membership fees are charged, they are strictly for operational, hosting, or prize fund purposes. There is no rake and no "house cut" taken beyond stated administrative costs.

Refunds: Policies on refunds or cancellations (if any) will be clearly stated alongside each tournament or service and may vary based on the type of event.

6. Disclaimers

No Liability: While we aim to maintain a secure and enjoyable platform, PLAN-D Poker disclaims liability for any financial losses, disputes among players, or technical malfunctions.

Use at Your Own Risk: By participating in any tournament or activity on the Site, you acknowledge and accept the inherent risks of card games or betting among peers.

7. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of PLAN-D Poker or its licensors. You may not reproduce, distribute, or use any content without explicit written permission of the licensors.

8. User-Generated Content

Ownership: You retain ownership of any content (e.g., forum posts) you submit. However, by submitting content, you grant PLAN-D Poker a non-exclusive, royalty-free, perpetual license to use, modify, and display it.

Prohibited Content: You agree not to post anything unlawful, offensive, or harmful to others. We reserve the right to remove any user-generated content that violates these Terms or any applicable laws.

9. Email Communications & Privacy

Email Consent: By opting in to receive tournament information via email, you agree to receive communications about upcoming tournaments, results, and important updates. You can opt out of these communications at any time by contacting us.

Data Collection: We collect and store your email address, tournament participation history, and transaction IDs for payment verification purposes. This information is used solely to provide our services and is never sold to third parties.

Email Security: While we implement security measures to protect your information, email communications are not completely secure. Do not send sensitive information (like private keys or passwords) via email. Our team and administrators will never ask you for your private keys or passwords.

Communication Frequency: We aim to send relevant tournament information only and will not spam your inbox. Typically, you will receive emails for tournament registrations, confirmations, and important updates only.

10. Indemnification

You agree to indemnify and hold harmless PLAN-D Poker, its affiliates, and their respective employees and agents from any claims, damages, or expenses arising out of your use of the Site or violation of these Terms.

11. Limitation of Liability

Under no circumstances shall PLAN-D Poker be liable for any direct, indirect, incidental, special, or consequential damages that result from your use or inability to use the Site.

12. Changes to Terms

PLAN-D Poker reserves the right to modify these Terms & Conditions at any time. Any changes will be effective immediately upon posting. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms & Conditions are governed by the laws of the United States of America. Any disputes shall be resolved exclusively by arbitration. The arbitration judge must be agreed upon by both parties to settle any and all disputes located in the United States of America.
